I dati personali possono essere forniti volontariamente dall’utente o, nel caso di dati relativi all’utilizzo del sito web, raccolti automaticamente durante la navigazione su questo sito web.

Qualsiasi utilizzo di cookie – o di altri strumenti di tracciamento – da parte di questo sito, o di terzi fornitori di servizi utilizzati attraverso questo sito, ha lo scopo di fornire il servizio richiesto dall’utente così come qualsiasi ulteriore scopo descritto nel presente documento e, se previsto, nella politica sui cookie.

  1. Finalità del trattamento

Il trattamento dei suoi dati personali può avere le seguenti finalità:

a) la conclusione di contratti e l’adempimento degli obblighi contrattuali (a carico ed a favore del titolare del trattamento), ovvero per finalità strettamente connesse alla gestione dei rapporti con la clientela, comprese le formalità e le procedure amministrative e contabili (ad esempio: esecuzione delle operazioni sulla base degli obblighi derivanti dal contratto stipulato con il cliente, ivi comprese le richieste di informazione; applicazione delle modalità di pagamento concordate; esigenze operative e amministrative; requisiti relativi al controllo dei pagamenti e delle fasi che ne derivano; accesso ai servizi, compresi i servizi interattivi, offerti sul sito; raccolta delle informazioni necessarie per risolvere reclami e/o richieste di informazioni relative ai servizi; risoluzione delle controversie – inadempimento contrattuale; solleciti; transazioni; arbitrato; contenzioso, ecc.);

b) adempimento degli obblighi di legge e delle disposizioni emesse da autorità a ciò legittimate dalla legge e da organi di vigilanza e controllo (Garante della Privacy);

c) Ricerche di mercato e indagini di customer satisfaction, condotte anche da società specializzate con indagini personali o telefoniche, questionari, sondaggi online e con lo scopo di offrire prodotti e servizi speciali (marketing);

d) Se l’interessato dà il suo consenso, eseguendo procedure automatizzate per analizzare le sue preferenze, abitudini e/o decisioni dei consumatori al fine di poterle offrire prodotti o
servizi su misura per i suoi interessi (profilazione);

  1. Tipologia e luogo del trattamento dei dati

Le seguenti categorie di dati personali possono essere oggetto di trattamento:

  1. cognome, nome e data luogo di nascita, residenza;
  2. codice fiscale e/o partita IVA;
  3. numero di telefono/indirizzo e-mail così come altri dati di contatto;
  4. indirizzo e numero struttura alberghiera di soggiorno;
  5. luogo di esecuzione della prestazione dei servizi contrattuali;
  6. dati relativi alle prestazioni da fornire in base al contratto;
  7. dati catastali e numero di parcella
  8. modalità di pagamento.

In relazione alle finalità di cui sopra, i suoi dati personali potranno essere trattati per le seguenti finalità:

  1. adempiere ai nostri obblighi contrattuali in essere tra le parti e fornire le informazioni e i servizi richiesti dall’interessato. Questo trattamento è necessario per adempiere ai nostri reciproci obblighi contrattuali;
  2. Invio di informazioni per i servizi attivi via e-mail e/o SMS così come con l’utilizzo di altri mezzi di comunicazione (come la conferma dell’appuntamento). Tale trattamento è necessario per l’adempimento dei nostri reciproci obblighi e/o eseguito con il consenso dell’utente;
  3. ricevere o trasferire a voi i pagamenti o rimborsi che riceviamo per vostro conto. Questo trattamento è necessario per l’adempimento dei nostri reciproci obblighi contrattuali;
  4. consentire di personalizzare il profilo utente sulle nostre piattaforme;
  5. dare accesso ai nostri servizi clienti e consentire all’utente di comunicare con l’azienda Funivie San Vigilio di Marebbe Spa. Questo trattamento è necessario per l’adempimento dei nostri reciproci obblighi contrattuali, che vengono effettuati con il consenso dell’utente e/o sono necessari per stabilire, esercitare o difendere i diritti legali.

I dati saranno trattati presso la sede del titolare del trattamento e in tutti gli altri luoghi in cui si trovano i soggetti coinvolti nel trattamento stesso. A seconda dell’ubicazione dell’utente, i dati possono essere trasferiti in un altro paese (anche al di fuori dell’UE e del SEE).   1. Base giuridica del trattamento ed obbligatorietà del conferimento

L’art. 6 I lettera a) del GDPR rappresenta per la nostra azienda la base giuridica per le operazioni di trattamento per le quali otteniamo il consenso per un determinato tipo di trattamento. Se il trattamento dei dati personali è necessario per l’esecuzione di un contratto di cui l’interessato è parte, come nel caso, ad esempio, di operazioni di trattamento necessarie per la fornitura di beni o la fornitura di altri servizi o corrispettivi, il trattamento si basa sull’art. 6 I lettera b) del GDPR. Lo stesso vale per le operazioni di trattamento necessarie per l’attuazione di misure precontrattuali, ad esempio in caso di richieste di informazioni sui nostri prodotti o servizi. Se la nostra azienda è soggetta ad un obbligo di legge che richiede il trattamento di dati personali, ad esempio per adempiere ad obblighi fiscali, il trattamento si basa sull’art. 6 I lettera. c) del GDPR. In rari casi, il trattamento dei dati personali può essere necessario per tutelare gli interessi vitali dell’interessato o di un’altra persona fisica. Questo sarebbe il caso, ad esempio, se un visitatore della nostra azienda fosse ferito e il suo nome, età, informazioni sull’assicurazione sanitaria o altre informazioni vitali dovessero essere rivelate a un medico, un ospedale o a terzi. In questi casi l’elaborazione dei dati si basa sull’art. 6 I lettera d) del GDPR. In ultima analisi, le operazioni di trattamento potrebbero basarsi sull’art. 6 I lettera f) del GDPR. Le operazioni di trattamento che non rientrano in nessuna delle suddette basi giuridiche si basano su tale base giuridica se il trattamento è necessario per salvaguardare un interesse legittimo della nostra azienda o di terzi, a condizione che non prevalgano gli interessi, i diritti fondamentali e le libertà fondamentali dell’interessato. Tali operazioni di trattamento sono per noi consentite in particolare perché sono state specificamente menzionate dal legislatore europeo. A tale riguardo, l’UE ha ritenuto che un interesse legittimo potrebbe essere presunto se l’interessato è un cliente del responsabile del trattamento (considerando 47 del GDPR, seconda frase).

  1. Raccolta, elaborazione e conservazione dei dati

I dati saranno raccolti presso l’interessato, si tratta pertanto di dati che l’interessato ci fornisce e di quelli derivanti dall’utilizzo dei servizi contrattuali.
I dati saranno trattati:

  1. utilizzando sistemi manuali e automatizzati;
  2. da persone autorizzate a svolgere tali compiti;
  3. adottando misure appropriate per garantire la riservatezza dei dati e per impedirne l’accesso da parte di terze persone non autorizzate.

Con particolare riferimento alle finalità del trattamento previste ai punti da c) a d) del precedente punto 3, si precisa in particolare che i dati personali sono trattati come segue:

  • utilizzando sistemi automatizzati di comunicazione di chiamata;
  • con mezzi di comunicazione elettronica quali posta elettronica, telefax, SMS (Short Message Service) o qualsiasi altro tipo di messaggio;
  • per telefono da un collaboratore o per posta.

Con riferimento alle finalità del trattamento previste ai punti a) e b) del precedente punto 3, i dati dell’interessato saranno conservati per l’intera durata del rapporto contrattuale, e successivamente alla sua cessazione, solo nella misura in cui si tratti di dati necessari per la risoluzione degli obblighi contrattuali assunti e per l’esecuzione di eventuali provvedimenti di legge, nonché per esigenze di tutela di natura contrattuale connesse o conseguenti al contratto.

Con riferimento alla finalità del trattamento d) prevista al precedente punto 3, il trattamento dei dati terminerà al più tardi – cioè se non l’interessato revochi il consenso in anticipo – al momento della cessazione del rapporto contrattuale.

In relazione alle finalità del trattamento c) e d) del precedente punto 3, il trattamento dei dati potrà proseguire fino alla revoca del consenso, ma in ogni caso non oltre i due anni dalla cessazione del rapporto contrattuale o dal rinnovo del consenso.

Non sono previsti processi decisionali automatizzati, per cui la possibilità di profilazione (a condizione che venga concesso il consenso corrispondente) rimane invariata.

  1. Divulgazione dei dati

Non condividiamo le informazioni che l’interessato ci fornisce, incluse le informazioni personali, con le suddette terze parti, tranne nei casi in cui:

  • È necessario coinvolgere un fornitore terzo per eseguire un contratto con l’utente al fine di semplificare o migliorare i nostri servizi (ad esempio, se addebitiamo costi o crediti all’utente in relazione ai servizi sulle piattaforme);
  • Utilizziamo analisti e i motori di ricerca come supporto per il miglioramento e l’ottimizzazione delle nostre piattaforme;
  • Possiamo distribuire parti delle nostre piattaforme attraverso API o widget da visualizzare sui siti web dei nostri partner commerciali. In tali casi, alcune delle informazioni di profilo pubblico dell’utente possono essere visualizzate su questi siti.

Possiamo associare le informazioni sull’utente, compresi i dati personali e le informazioni sui cookie che inviamo e riceviamo dai nostri partner commerciali, in conformità con le leggi applicabili e, se necessario, con il consenso dell’utente. Possiamo utilizzare queste informazioni e le informazioni combinate per le finalità di cui sopra.

  1. Diritti dell’interessato

a) Diritto alla conferma del trattamento

Ogni soggetto interessato dal trattamento di dati personali ha il diritto, come garantito dalle direttive e dal legislatore europeo, di richiedere al titolare del trattamento di ottenere conferma in merito al fatto che i dati personali che lo riguardano vengano effettivamente elaborati. Se una persona interessata desidera avvalersi di questo diritto di conferma del trattamento, può contattare un collaboratore del titolare del trattamento in qualsiasi momento.

b) Diritto all’informazione

Ogni soggetto interessato dal trattamento di dati personali ha il diritto, come garantito dalle direttive e dal legislatore europeo, di ricevere dal titolare del trattamento, in qualsiasi momento, informazioni gratuite sul trattamento di dati personali a lui riferiti, che lo coinvolgono e di ottenere anche una copia dei dati memorizzati. Inoltre, l’Autorità europea di regolamentazione e le linee guida prevedono che l’informativa, che viene messa a disposizione della persona interessata, contenga le seguenti informazioni:

  • la finalità del trattamento
  • le tipologie di dati personali che vengono trattati
  • i destinatari o le categorie di destinatari a cui sono stati diffusi o possono essere diffusi i dati personali trattati con particolare riferimento ai destinatari aventi sede in Paesi Terzi rispetto all’UE così le organizzazioni internazionali
  • se possibile, che venga comunicato il periodo di conservazione previsto dei dati personali trattati e, ove non possibile, i criteri per la definizione del periodo di conservazione
  • il diritto di rettifica o cancellazione dei dati personali che lo riguardano, la limitazione del trattamento da parte del titolare del trattamento o il diritto di opporsi a tale trattamento
  • la possibilità di avvalersi di un diritto di ricorso ad una autorità competente in materia
  • nel caso in cui di dati personali trattati non vengano rilevati presso l’interessato devono essere fornite esaustive informazioni sulla provenienza dei dati
  • la possibilità che i dati vengano trattati in maniera automatizzata con particolare riferimento alle attività di profilazione in ottemperanza all´Art. 22 comma 1 e 4 del GDPR e che almeno in questi casi vengano fornite debite e opportune informazioni in merito alle logiche di trattamento coinvolte così come sulla portata e l’impatto previsto da questo particolare tipo di trattamento sui dati personali della persona interessata coinvolta.

Inoltre, la persona interessata ha il diritto di accedere alle informazioni in merito al fatto che i dati personali siano stati trasmessi a un paese terzo o ad un’organizzazione internazionale. Al verificarsi di questo caso, l’interessato ha il diritto di ottenere informazioni sull’utilizzo di appropriate garanzie di sicurezza in relazione al trasferimento dei dati interessati.

Se una parte interessata desidera esercitare questo diritto all’informazione, può in ogni momento contattare un collaboratore del titolare del trattamento.

c) Diritto di rettifica

Ogni soggetto interessato dal trattamento di dati personali ha il diritto, come garantito dalle direttive e dal legislatore europeo, di chiedere la correzione immediata dei dati personali errati che lo riguardano. Inoltre, l’interessato ha il diritto di chiedere il completamento dei dati personali che lo riguardano e che risultano essere incompleti, anche mediante una dichiarazione complementare, tenendo conto delle finalità del trattamento.

Se una parte interessata desidera esercitare questo diritto all’informazione, può in ogni momento contattare un collaboratore del titolare del trattamento.

d) Diritto alla cancellazione (diritto all’oblio)

Qualsiasi persona interessata dal trattamento di dati personali ha il diritto, garantito dalle direttive e dal legislatore europeo di richiedere al titolare del trattamento di cancellare immediatamente i dati personali che lo riguardano, a condizione che uno dei seguenti motivi sia soddisfatto e che il trattamento non sia necessario:

  • i dati personali acquisiti e trattati furono memorizzati per finalità che non sono più necessarie e valide.
  • la persona interessata revoca il consenso dato, in base al quale ha avuto il luogo il trattamento dei dati nel rispetto di quanto previsto dall’Art, 6 comma 1 lettera a) del GDPR oppure dell´Art. 9 comma 2 lettera a) del GDPR e contestualmente è privo di qualsiasi ulteriore fondamento giuridico finalizzato al trattamento.
  • la persona interessata si oppone al trattamento dei dati ai sensi dell´Art. 21 comma 1 del GDPR e non vi sono motivi precedenti e legittimi per il trattamento oppure la persona interessata si oppone al trattamento dei dati ai sensi dell’Art, 21 comma 2 del GDPR.
  • I dati personali della persona interessata sono stati trattati in maniera illegale o indebita.
  • La cancellazione dei dati personali è necessaria per adempiere a un obbligo legale ai sensi del diritto dell’Unione o di quello nazionale a cui è soggetto il titolare del trattamento.
  • I dati personali trattati sono stati raccolti in relazione ai servizi della società dell’informazione offerti ai sensi dell’Art. 8 comma 1 del GDPR.

Se uno qualsiasi dei suddetti motivi è corretto e una persona interessata desidera avviare la procedura di cancellazione dei dati personali detenuti dell’azienda Funivie San Vigilio di Marebbe Spa, può contattare a tale fine un collaboratore del titolare del trattamento in qualsiasi momento. Il collaboratore dell’azienda Funivie San Vigilio di Marebbe Spa provvederà a soddisfare immediatamente la richiesta di cancellazione.

Nel caso in cui i dati personali della persona interessata siano stati resi pubblici dell’azienda Funivie San Vigilio di Marebbe Spa e la nostra azienda risulta essere titolare del trattamento ai sensi dell´Art. 17 comma 1 del GDPR e pertanto obbligata alla cancellazione dei dati trattati, l’azienda Funivie San Vigilio di Marebbe Spa considerata la tecnologia disponibile ed il costo di implementazione di misure appropriate, comprese quelle tecniche, si impegna ad informare anche altri responsabili del trattamento dei dati coinvolti in merito alla richiesta di cancellazione dei dati personali pervenuta dalla persona interessata. Se una parte interessata desidera esercitare questo diritto all’informazione, può in ogni momento contattare un collaboratore del titolare del trattamento.

e) Diritto alla limitazione del trattamento

Qualsiasi persona interessata dal trattamento di dati personali ha il diritto, riconosciuto dalle direttive europee e dall’autorità di regolamentazione, di richiedere al titolare del trattamento di limitare l’elaborazione nel caso in cui venga soddisfatta almeno una delle seguenti condizioni:

  • l’accuratezza dei dati personali è contestata dall’interessato per un periodo di tempo che consenta al responsabile di verificare l’esattezza dei dati personali in suo possesso.
  • il trattamento è illegale, l’interessato si rifiuta di cancellare i dati personali e richiede invece la limitazione dell’uso dei dati personali.
  • il titolare del trattamento non ha più bisogno di trattenere oltre i dati personali ai fini del trattamento, ma l’interessato li richiede per far valere, esercitare o difendere i propri diritti legali.
  • la persona interessata ha presentato obiezioni al trattamento ai sensi dell´ Art. 21 comma 1 del GDPR e non è ancora chiaro se le ragioni legittime al trattamento della persona titolare siano superiori a quelle della persona interessata.

Nel momento in cui si verificasse una delle cause di cui sopra, e la persona interessata volesse richiedere la limitazione al trattamento di dati personali che sono stati memorizzati dell’azienda Funivie San Vigilio di Marebbe Spa, può rivolgersi in qualsiasi momento ad un collaboratore del titolare. Il collaboratore dell’azienda Funivie San Vigilio di Marebbe Spa si preoccuperà di provvedere alla limitazione del trattamento dei dati.

f) Diritto alla portabilità

Qualsiasi persona implicata nel trattamento dei dati personali ha il diritto, riconosciuto dalle direttive e dai regolamenti europei in merito al trattamento di dati personali, di ottenere i dati personali, che ha messo a disposizione di un titolare del trattamento, in un formato strutturato, coerente e leggibile da strumenti informatici. Inoltre, la persona interessata ha il diritto di trasferire questi dati, senza venire ostacolata dal titolare cedente, ad un altro titolare del trattamento entrante purché questo rapporto si basi su una relazione in ottemperanza dell´Art. 6 comma 1del GDPR o dell´Art. 9 comma 2 lettera a) del GDPR così come su un contratto ai sensi dell´Art. 6 comma 1 lettera b) del GDPR ed il trattamento ha luogo utilizzando procedure automatizzate, purché lo stesso non sia necessario per l’esecuzione di un obbligo che sia di interesse pubblico o nell’esercizio dell’autorità pubblica.

Inoltre, nell’esercizio del loro diritto alla portabilità dei dati ai sensi dell’Art. 20, comma 1 del GDPR, l’interessato ha il diritto di ottenere che i dati personali siano trasmessi direttamente da un titolare ad un altro, nella misura in cui ciò sia tecnicamente fattibile e in tal caso questo non pregiudichi i diritti e la libertà degli altri.

Se una parte interessata desidera esercitare questo diritto all’informazione, può in ogni momento contattare un collaboratore dell’azienda Funivie San Vigilio di Marebbe Spa.

g) Diritto d’opposizione

Qualsiasi persona interessata dal trattamento di dati personali ha il diritto conferito dalle direttive europee e dall’autorità di regolamentazione, di opporsi in qualsiasi momento, e per motivi derivanti dalla una situazione particolare, al trattamento dei dati personali ad essa relativi a norma dell’Art. 6, comma 1, lettera e) del GDPR. Questo diritto vale anche per la profilazione basata su queste premesse.

L’azienda Funivie San Vigilio di Marebbe Spa non elabora più i dati personali in caso di opposizione, a meno che non siamo in grado di stabilire validi motivi legittimi per il trattamento che prevalgono sugli interessi, i diritti e le libertà dell’interessato, o il trattamento ha lo scopo di far valere, esercitare o difendere rivendicazioni legali dell’interessato.

Nel caso in cui l’azienda Funivie San Vigilio di Marebbe Spa elabori i dati personali al fine di gestire pubblicità diretta, l’interessato ha il diritto di opporsi in qualsiasi momento al trattamento dei dati personali ai fini di tale esercizio. Ciò vale anche per la profilazione, nella misura in cui questa sia associata a tale pubblicità diretta. Se l’interessato si oppone all’elaborazione dell’azienda Funivie San Vigilio di Marebbe Spa per scopi di marketing diretto, l’azienda Funivie San Vigilio di Marebbe Spa si impegna a non elaborare più i dati personali per tali scopi.

Inoltre, l’interessato ha diritto, per motivi derivanti dalla una sua particolare situazione, di opporsi al trattamento dei dati personali che lo riguardano da parte dell’azienda Funivie San Vigilio di Marebbe Spa anche a fini di ricerca scientifica o storica o a fini statistici ai sensi dell’Art. 89 comma 1 del GDPR, a meno che tale trattamento non sia necessario per adempiere a un obbligo di interesse pubblico.

Per esercitare il diritto di opposizione, l’interessato può contattare direttamente un qualsiasi collaboratore dell’azienda Funivie San Vigilio di Marebbe Spa o qualsiasi altro collaboratore. L’interessato è inoltre libero, nel contesto dell’utilizzo dei servizi della società dell’informazione, nonostante la direttiva 2002/58 / CE, all’esercizio del suo diritto di opposizione mediante procedure automatizzate che utilizzano specifiche tecniche.

h) Processo decisionale automatizzato compresa la profilazione

Qualsiasi persona interessata dal trattamento di dati personali ha il diritto, come garantito dal legislatore europeo e dalle direttive, di non essere assoggettata a una decisione basata esclusivamente sul trattamento automatizzato, inclusa la profilazione, che abbia un effetto giuridico su se stesso o, in modo analogo, che la influenzi in modo significativo; a meno che la decisione (1) sia necessaria per la conclusione o l’esecuzione di un contratto tra l’interessato e il titolare del trattamento o (2) sia consentita dalla legislazione dell’Unione o dello Stato membro a cui è soggetto il titolare del trattamento e che la legislazione preveda misure appropriate al fine di salvaguardare i diritti e le libertà nonché gli interessi legittimi dell’interessato o (3) con il consenso esplicito dell’interessato stesso.

Se la decisione (1) è richiesta per concludere o eseguire un contratto tra l’interessato e il titolare del trattamento o (2) è fatta con il consenso esplicito dell’interessato, l’azienda Funivie San Vigilio di Marebbe Spa adotterà le misure appropriate per salvaguardare i diritti e le libertà e gli interessi legittimi della persona interessata, compreso quanto meno il diritto di ottenere l’intervento di una persona incaricata da parte del titolare del trattamento per esprimere la propria posizione ed impugnare così la decisione.

Se l’interessato desidera rivendicare i diritti inerenti decisioni automatizzate, può contattare in qualsiasi momento un collaboratore del titolare del trattamento.

i) Diritto di revocare un consenso alla protezione dei dati

Qualsiasi persona interessata dal trattamento di dati personali ha il diritto, concesso dalla direttiva europea e dall’autorità regolatoria, di revocare il consenso al trattamento dei dati personali in qualsiasi momento.

Se l’interessato desidera rivendicare i diritti inerenti decisioni automatizzate, può contattare in qualsiasi momento un collaboratore del titolare del trattamento.

  2. Steuernummer u./o. Mehrwertsteuernummer;

In Bezug auf die oben genannten Zwecke können Ihre persönlichen Daten für folgende Zwecke verarbeitet werden:

  1. Erfüllung unserer Verpflichtungen aus Verträgen zwischen Ihnen und uns und Bereitstellung der von Ihnen gewünschten Informationen und Dienstleistungen. Diese Behandlung ist zur Erfüllung unserer gegenseitigen vertraglichen Verpflichtungen notwendig;

  1. Erhebung, Modalitäten der Verarbeitung und Speicherung der Daten

Die Daten werden bei der betroffenen Person erhoben, es handelt sich also um die Daten, die Sie uns zur Verfügung stellen, und um diejenigen, die aus der Nutzung der vertraglich festgelegten Dienstleistungen hervorgehen.
Die Datenverarbeitung erfolgt:

  1. mittels Verwendung manueller und automatisierter Systeme;
  2. durch zur Ausführung dieser Aufgaben ermächtigte Personen;
  3. durch das Ergreifen von Maßnahmen, die geeignet sind, die Vertraulichkeit der Daten zu gewährleisten und den Zugang zu diesen durch unbefugte Dritte zu vermeiden.

Mit Bezug auf die Zwecke von c) bis d) des vorstehenden Punktes 3 wird insbesondere darauf hingewiesen, dass die personenbezogenen Daten auch folgendermaßen verarbeitet werden:

Mit Bezug auf die Zwecke a) und b) des vorstehenden Punktes 3 werden Ihre Daten für die gesamte Dauer des Vertragsverhältnisses gespeichert, und nach dessen Beendigung geschieht dies – lediglich soweit es die entsprechend notwendigen Daten angeht – im Hinblick auf das Erlöschen der vertraglich eingegangenen Pflichten und für die Vornahme aller etwaig gesetzlich vorgeschriebenen Schritte sowie  für Schutzanforderungen auch vertraglicher Art, die mit dem Vertrag verbunden sind oder hieraus herrühren.

  1. Rechte der betroffenen Person

a) Recht auf Bestätigung

Jede betroffene Person hat das vom Europäischen Richtlinien- und Verordnungsgeber eingeräumte Recht, von dem für die Verarbeitung Verantwortlichen eine Bestätigung darüber zu verlangen, ob sie betreffende personenbezogene Daten verarbeitet werden. Möchte eine betroffene Person dieses Bestätigungsrecht in Anspruch nehmen, kann sie sich hierzu jederzeit an einen Mitarbeiter des für die Verarbeitung Verantwortlichen wenden.

b) Recht auf Auskunft

Jede von der Verarbeitung personenbezogener Daten betroffene Person hat das vom Europäischen Richtlinien- und Verordnungsgeber gewährte Recht, jederzeit von dem für die Verarbeitung Verantwortlichen unentgeltliche Auskunft über die zu seiner Person gespeicherten personenbezogenen Daten und eine Kopie dieser Auskunft zu erhalten. Ferner hat der Europäische Richtlinien- und Verordnungsgeber der betroffenen Person Auskunft über folgende Informationen zugestanden:

  • die Verarbeitungszwecke
  • die Kategorien personenbezogener Daten, die verarbeitet werden
  • die Empfänger oder Kategorien von Empfängern, gegenüber denen die personenbezogenen Daten offengelegt worden sind oder noch offengelegt werden, insbesondere bei Empfängern in Drittländern oder bei internationalen Organisationen
  • falls möglich die geplante Dauer, für die die personenbezogenen Daten gespeichert werden, oder, falls dies nicht möglich ist, die Kriterien für die Festlegung dieser Dauer
  • das Bestehen eines Rechts auf Berichtigung oder Löschung der sie betreffenden personenbezogenen Daten oder auf Einschränkung der Verarbeitung durch den Verantwortlichen oder eines Widerspruchsrechts gegen diese Verarbeitung
  • das Bestehen eines Beschwerderechts bei einer Aufsichtsbehörde

c) Recht auf Berichtigung

Jede von der Verarbeitung personenbezogener Daten betroffene Person hat das vom Europäischen Richtlinien- und Verordnungsgeber gewährte Recht, die unverzügliche Berichtigung sie betreffender unrichtiger personenbezogener Daten zu verlangen. Ferner steht der betroffenen Person das Recht zu, unter Berücksichtigung der Zwecke der Verarbeitung, die Vervollständigung unvollständiger personenbezogener Daten — auch mittels einer ergänzenden Erklärung — zu verlangen.

Möchte eine betroffene Person dieses Berichtigungsrecht in Anspruch nehmen, kann sie sich hierzu jederzeit an einen Mitarbeiter des für die Verarbeitung Verantwortlichen wenden.

d) Recht auf Löschung (Recht auf Vergessen werden)

Jede von der Verarbeitung personenbezogener Daten betroffene Person hat das vom Europäischen Richtlinien- und Verordnungsgeber gewährte Recht, von dem Verantwortlichen zu verlangen, dass die sie betreffenden personenbezogenen Daten unverzüglich gelöscht werden, sofern einer der folgenden Gründe zutrifft und soweit die Verarbeitung nicht erforderlich ist:

  • Die personenbezogenen Daten wurden für solche Zwecke erhoben oder auf sonstige Weise verarbeitet, für welche sie nicht mehr notwendig sind.
  • Die betroffene Person widerruft ihre Einwilligung, auf die sich die Verarbeitung gemäß Art. 6 Abs. 1 Buchstabe a DS-GVO oder Art. 9 Abs. 2 Buchstabe a DS-GVO stützte, und es fehlt an einer anderweitigen Rechtsgrundlage für die Verarbeitung.
  • Die betroffene Person legt gemäß 21 Abs. 1 DS-GVO Widerspruch gegen die Verarbeitung ein, und es liegen keine vorrangigen berechtigten Gründe für die Verarbeitung vor, oder die betroffene Person legt gemäß Art. 21 Abs. 2 DS-GVO Widerspruch gegen die Verarbeitung ein.
  • Die personenbezogenen Daten wurden unrechtmäßig verarbeitet.
  • Die Löschung der personenbezogenen Daten ist zur Erfüllung einer rechtlichen Verpflichtung nach dem Unionsrecht oder dem Recht der Mitgliedstaaten erforderlich, dem der Verantwortliche unterliegt.
  • Die personenbezogenen Daten wurden in Bezug auf angebotene Dienste der Informationsgesellschaft gemäß Art. 8 Abs. 1 DS-GVO erhoben.

  • Die Richtigkeit der personenbezogenen Daten wird von der betroffenen Person bestritten, und zwar für eine Dauer, die es dem Verantwortlichen ermöglicht, die Richtigkeit der personenbezogenen Daten zu überprüfen.
  • Die Verarbeitung ist unrechtmäßig, die betroffene Person lehnt die Löschung der personenbezogenen Daten ab und verlangt stattdessen die Einschränkung der Nutzung der personenbezogenen Daten.
  • Der Verantwortliche benötigt die personenbezogenen Daten für die Zwecke der Verarbeitung nicht länger, die betroffene Person benötigt sie jedoch zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprü
  • Die betroffene Person hat Widerspruch gegen die Verarbeitung gem. Art. 21 Abs. 1 DS-GVO eingelegt und es steht noch nicht fest, ob die berechtigten Gründe des Verantwortlichen, gegenüber denen der betroffenen Person überwiegen.

Ferner hat die betroffene Person bei der Ausübung ihres Rechts auf Datenübertragbarkeit gemäß Art. 20 Abs. 1 DS-GVO das Recht, zu erwirken, dass die personenbezogenen Daten direkt von einem Verantwortlichen an einen anderen Verantwortlichen übermittelt werden, soweit dies technisch machbar ist und sofern hiervon nicht die Rechte und Freiheiten anderer Personen beeinträchtigt werden.

Zur Geltendmachung des Rechts auf Datenübertragbarkeit kann sich die betroffene Person jederzeit an einen Mitarbeiter des Unternehmens Seilbahnen St. Vigil in Enneberg AG wenden.

  3. Receiving payments from the user or transferring payments to you that we receive on your behalf. This treatment is necessary for the performance of our mutual contractual obligations;

  • The data subject objects to the processing pursuant to Article 21(1) GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) GDPR
  • The personal data have been processed unlawfully
  • The erasure of the personal data is necessary for compliance with a legal obligation under Union or Member State law to which the controller is subject
  • The personal data have been collected in relation to information society services offered pursuant to Article 8(1) GDPR.
